I can't see any reason why KTM couldn't have put the air filter on the other side of the divider. Similar frame to hold it in place - job done.
The air box must get very hot situated where it is, but Why the warping and leaks never showed up in testing is a mystery. Maybe they tested somewhere with no dust and just didn't notice? But Fit a better seal or a gasket - again, job done.
At least it's an easy fix for an owner. Easier than heading off a GS LC cam chain failure anyway
