2016 gsa rust issue

Everything is environmental. However the product should be constructed to last its lifetime in ordinary environmental conditions expected by the product type and the conditions that will be presented. If I leave a blender out in the rain, and it stops working, then its environmental. However the blender was never intended to be out in the rain. It's a product defect that is either a defect in design, or a defect in materials.

Well after you've thrown more money than the bike cost, at BMW, let us know what the result is.

Not sure if you guys understand how lawsuits work in the states.

Here you don't pay for consumer lawsuits.

I go the the office of the attorney general, say the bike is a defective product, and the warranty was not honored. They then call the dealer. At this point the dealer has the option to make it right, or the attorney general files the lawsuit for me. They sue BMW and the dealer. About 60 days later you sit down in mediation. The attorney general says something to the effect of, "he has been damaged in the amount of 10 million dollars" bmw and the dealers lawyer says, "well bmw wants to pay 3 cents" and they work out a deal. If no deal can be reached BMW and the dealer shell out $15,000 for the first trial. I on the other hand have paid nothing. So its at mediation that they pay. Because it makes financial sense to pay less at mediation then take it to trial, pay lawyers, and run the chance of losing not only the repair costs, but also punitive damages and loss of use damages. At the end of 3 years of trials they could spend several hundred thousand dollars to defend their case, meanwhile I still have not paid anything. Consumer protection is good here. Even if the attorney general rejected the case a lawyer does the case and takes a portion of the settlement. Why would they? Because BMW is not stupid. They will pay up at mediation for a lessor amount.

The reason they reject claims is because 90% of people will never bother to sue, and they make the money up. Its also less expensive to settle at mediation then to do the repairs. They basically have to refund my purchase of the bike at most, and if they can escape with a $5000 settlement at mediation, they make out better then paying for the cost of the bike.

This has left such a bad taste in my mouth that I will not buy a BMW again. I am going to go Honda from now on. They sell a 1200 as well.
I am actually going to go out of my way and post a video on youtube showing how bad the bike is. I have photos of the rust showing up on month 3. I have a channel with half a million views, it will be noticed.
It is a disgrace that BMW can't spend more than 5 quid on R&D. Spending another $5 a bike on the high quality paints that would not only hold up to salt air, but to knocks and chips as well would do wonders. Modern paint tech is unbelievable. When was the last time you saw the body of a car rusting without damage? It doesn't happen anymore. Last I saw was late 90's trucks with rust. I think I will see what the dealer wants to do, because its them that will also be sued. If they will just take a markdown on the bike, I would keep it, strip the bike and repaint the frame in 2 part epoxy.

I had a 2012 Brand New Honda VFR1200F

6 Warranty Claims in 2 years. One very serious with front calipers binding and bringing bike to a dead stop TWICE.

Shaft drives disintegrating, rear shocks repeatedly failing, brakes failing...

My 1976 Honda GL1000 has less rust than my 2014 R9T ! BMW build quality is utter shyte at the moment.
 
All bike manufacturers are the same in my view.
I had a Honda Africa twin which was rusting on the frame after 2 years, a Yamaha Super Tenere that had rusted on the frame after a couple of years... the best bike I had was my gs 1150 which was fantastic quality.
 
It seems like what you are all saying is, if you want a keep a new bike... Strip it to the frame, sand blast it, Etch primer it, Epoxy paint it, apply 3M clear protective film, reassemble.
I was looking for a bike for my Arctic circle to ushuaia ride. Needs to be under 200 kilos... Opinions on what bike is best under 200 kilos that they sell in America?
Was looking at the yamaha tw200.
 
Here is not the best place to ask about offroad stuff try ADV riders.

Depends on how rough going the roads are. Most trail/dirt bikes will need a replacement shock to cope with luggage etc. I weigh 155lbs , I would not put more weight on the bike as standard.

welding looks pretty poor too. That top weld shows signs of lack of adhesion, too much heat and not enough care taken. Bottom one shows signs of spatter that was never cleaned off, so in essence the pre paint prep was obviously terrible and no wonder it is rusting from beneath. This type of quality (or lack of) should never have passed their QC inspections??
