Yep, Chester should have raised it with BMW Customer Service months ago - and the got involved only then because I had contacted them directly.

Personally, I believe they will resolve this amicably next week when everyone is back at work - although it should have been resolved last January.

Might point them in the direction of this thread because there's some useful stuff on here.
 
The rules for small claim in England states that you must make reasonable attempts to resolve the issue and you may also be expected to go to mediation before the court will accept the case. There also must be a written request for compensation and a time allowed for a response. Given this has just started I think all the talk of court action is jumping the gun a bit. Come next week when alleged absent managers are back it might well all get sorted out amicably.

This is far from the first time someone has rejected a bike from BMW and from what I can see they have all ended pretty well.

I agree with all of this. You must make a good attempt at resolution first, which it sounds like the guy has, it's been going on for over a year.

My point about small claims comes from experience of spending a lot of money with solicitors only to realise they have no power to enforce anything, only a court judge of some sort has the power, so any number of letters from your favourite solicitor, personal phone calls and meetings with the dealer are all worthless if the dealer chooses to avoid or stall your case. At the end of the day BMW themselves can just chuck any letter in the bin but a court summons cannot be ignored though, so the choices are either rely on your statutory / consumer rights of which lets hope the dealership take note of and sort it out now, or employ a solicitor to represent a full on court case - very expensive and should be avoided. A cheaper option is to consider the small claims court if that applies.

In my earlier post I have suggested the guy should gather evidence in the form of letter headed paper from the dealer stating all of the times and dates of attempts to fix the problem. This is evidence one can use for any action you wish to take and should now be the first step in resolution. By doing this evidence gather, the dealership will realise you are serious, and from their response to your request for this information the guy will be able to gauge where he stands. By getting the times and dates on their letter headed paper by definition they are in admission of the facts. Even if when normal service is resumed and the guy gets a verbal agreement they will replace the bike, I would still expect to have the written evidence in case there is some broken agreement later on ( hidden costs etc).

I have resolved two cases this way. One that did go to small claims, and then on to mediation the other for a new vehicle with a faulty clutch after only 5000 miles they accused my wife of burning out through misuse. I spent what amounted to weeks talking to them on the phone and in meetings, it was only when I started to gather evidence they could see I was in preparation to discuss with other parties they decided to sort the problem out under warranty and even gave me use of the dealer principles own wife's car because they didn't have one of the same spec' available other than hers.

As I understand it the only issue with the bike is that if you don't ride it for a period of time and then try to start it the battery is flat. This is obviously not how the bike should behave. I left my 2014 GSA outside under a cover for three months and went to use it last weekend and it started first press (without any of the 'trickle charger' bollocks). I would have a simple question for the dealer, in all the time the dealer has had the bike has the battery flattened and failed to start the bike? If not then the dealer will have a difficult time convincing BMW to spend money fixing something that doesn't show any fault. If it has never failed to start at the dealers then I would suspect a radio interference problem near your home.

I notice some posts have confused my idea with suggestion of interference jamming the signal between the key fob and the bike stopping the bike receiving the signal to disable the immobiliser. I am not saying this is the problem. I am suggesting there is a transmission that looks like a signal from the key fob so the bike keeps trying to receive it and decode it, so this keeps the electronics 'awake' and drawing current.

Does your bike have an alarm because the alarm remote control receiver on the bike goes to sleep after a few minutes to stop it draining the battery. Perhaps if the electronics are receiving a signal that looks like an alarm control transmission, the electronics never go to sleep, flattening the battery.
 
No alarm and, according to BMW Assist, who have been out a few times, the bike is shutting down and there is no drain on the battery when shut down.

It has been used most days for commuting so outside and not on the charger (in reasonable weather) and normally will start - but how much power is in the battery at that time is not known. It's only been stabled in really wet weather and put on the trickle charger if not being used for a week or so.

However, for instance, Chester returned it to me one Thursday afternoon. I rode it into the stables and turned it off (not on the trickle charge). They had checked the battery several times and changed it at least once.

The bike has been recovered to them dead and even BMW Assist were at a loss.

I have never had such an issue with any previous GS.

Went back to it on the Saturday and completely dead again, just after the 12 ,month service, a supposed look at why it kept dying and the fitting of additional lights.

Either way, I am a technophobe and rely on the dealer / manufacturer to resolve the problem.

This is not a daily fault but one that happens from time to time as per my first post.
 
Well they've had it a month apart from coming home for two days.

BMW have told Chester to replace a part, which won't be here till the end of January - and they've offered me a loan bike, so that'll be two months then.

I've reiterated that I want to reject it as they've had twelve months to sort it now. I have no confidence in the bike at all and there is no guarantee that this part will sort it, so they've gone away to ponder.

I really had hoped for something positive by now.
 
Sorry to hear, there is still no resolution. I suggest a note in the diary for the 1 February. When they get tired of your voice they will resolve it one way or another. Best of luck. :aidan

Stick to your guns about rejecting the bike regardless of what the dealer does from now on, you'll never feel good about the bike after this carry on. It sounds like you've been more than reasonable and patient. Dealers don't seem to recognise that on the whole keeping bike buyers happy results in them buying more bikes more often.

Your dealer really is a shower of shite. Do you have any direct dialogue with BMW, or is everything being done through the dealer?
 
Chester Motorrad are proposing to replace the ECR unit anyway but I've told both them and BMW Motorrad that I want to reject it.

I'd prefer my money back so that I can buy elsewhere but I'd settle for a replacement bike.

Really terribly pissed off now.
 
Stick to your guns. Be adamant that you are rejecting this bike having lost all faith in it.

Demand either a full refund or a brand new bike.

Don't let them fob you off.

You have been very patient and reasonable throughout but now it's time to toughen up.

I genuinely hope that you get this sorted.
 
Well I have spoken with Ben Perry again this morning and, I'm delighted to say, that the bike will be replaced with a contribution from me for the mileage on my old bike, which is fair enough.

So thanks to everyone who has contributed on here and to Ben Perry, of BMW Motorrad, who has been really helpful in resolving the matter.

It's just a great shame that it has taken so long to resolve this but I'm happy with the arrangement.
 
What about a contribution to you from BMW for lost time, lost enjoyment & frustration?
 
Well that's a fair point but for a relatively small contribution from me, It gets me a brand new bike with all the extras from my old bike and peace of mind.

I don't want to drag it on any longer and am happy with the arrangement.

They are lending me a bike whilst the new one is ordered and got ready so if I can drag this out till 1 March........

So after 100 odd post of all manor of get Lawers take them to court blah blah the first few responses were correct! It took longer than it should have once you pulled the trigger but the crimbo break didn't help there. Other than that it's a fair deal IMHO depending on what your contribution is of course. If your happy then that's all that matters in the end.

Hope you enjoy your new bike and have many miles of trouble free riding.
 
I'm very happy that you have finally managed to reject the bike and agree a deal on a new one.

In my opinion you shouldn't have to pay anything after all the hassle that you have gone through but if your happy with the deal that's all that matters.

Let's hope that your replacement bike is perfect because you deserve it.
 
Wow, what a drama! Sure you are relieved to move on and get riding your new bike, which I hope will be hassle free :thumb2
