guys at the end of the day I feel that i am being discriminated here for living in NI either by the government (I pay same taxes as Scotland England and Wales) BMW protecting their local dealer and the DVLA who wont respect my citizenship by saying I DONT LIVE IN THE UK I work 6 months a year in Southern Spain and have bought a car out there and im not a resident but have had less hassle than this The joke is I would be paying for the damm bike in UK pounds Stirling which is my currency

quote mike
{BMW do seem to prevent competition between dealers on new unit prices. Their rationale is that discounting new prices ultimately is reflected in second-hand values.}

mike, if you ever try to trade in your second hand bm with bmw n.i. (hursts)
you will see that this argument does not stand up

PAUL
BET YOU WISH YOU HAD JUST KEPT YOUR VSTROM :D

It's not a caase of you not living in the UK with the DVLA, it's because they can't handle a new registration in NI as we have our own system and department.

As I mentioned earlier BMW are using this fact to stop the sale from a mainland dealer (indirectly or directly who can say).

I know it is their policy that a bike cannot leave the dealers unregistered, but it's the fact they wont release the V55 documentation which is causing the whole problem and something that needs to be addressed for the benefit of all NI owners in the future.

Guys what happens when car dealers go over to the mainland uk and buy new cars ?? I worked for a garage and we had cars bought in mainland uk and there didnt seem to be any probs getting the reg sorted out. Are bikes any different?

It's "normally" not a problem with any new vehicle as the person bringing it into NI would have the V55 new vehicle registration paperwork and use that to get it registered.

In this case BMW won't seem to be willing to release the paperwork.

AFAIK it's illegal!

This is NOT an issue about cross-border sales (VW linky above) - the UK=GB+NI.

As Thunder said

"Ok. So then this is nothing to do with being in the UK, it's simply a case of BMW using the fact that NI has it's own vehicle registration system to identify people buying a motorcycle outside their "designated" dealer area.

Anyone in England , Scotland or Wales who use the DVLA system cannot be "identified" by their address so can buy a bike from whoever they which to deal with, but we in this part of the world are therefore being disadvantaged as we cannot choose which dealer we wish to use."

AFAIK BWM is clearly in breach of the EU Block Exemption regulations about the supply of vehicles anywhere in the EU.

They ARE using the DVLA/DVLA(NI) card as an excuse - they should allow the V55 to be sent and cannot stop Dealers selling unregistered vehicles anywhere in the UK (if the vehicle already belongs to the Dealer - it may technically still belong to BWM UK if not consigned to the Dealer, depends on stock funding policy).

BBC Watchdog anyone?

A

PS I'm not a lawyer!

That may well be the case but if there exists such a policy it must be to support the sole NI dealership.

Would it really be in NI BMW owning residents best interest if that dealership ceased trading?

I suspect that BMW can stipulate that their products are not sold unregistered. I can't see how that would breach any EC directives. They are not refusing sale, they are stipulating that it must be registered in the country of sale. Technically the UK is not a country. It is an amalgam of countries, much like the EU is in certain respects.

If you wish to travel to an EU country and buy a BMW to bring to the UK, you can do so but the BMW will be registered in that EU country before sale and be re-registered on arrival here.

If DVLA/NI and DVLA Swansea were one organisation, the problem wouldn't exist.

The whole UK/GB/EU, when is it one place or separate entities is a minefield.

I recently had cause to write to BMW on an issue (not dealer related) and had to send two reminders before getting a response.
I finally wrote to;
Adrian Roddick
Managing Director
Bmw Motorrad UK
Ellesfield Avenue
Bracknell
Berkshire
RG12 8TD

I didn' t achieve the result I was seeking however I received a speedy and conclusive response, you may wish to drop him a line re this sorry tale.
My experience of talking to Motorrad customer helpline wasn' t great, helpful enough but short on knowledge.

Hope it all works out for you.........finally.

not as simple as that aidan as ihave paid a deposit in england with another dealer so watch this space

So as far as I was concerned you had sorted a deal on a bike for delivery from Hurst's on the 22nd of May, and your concern was getting your deposit back on the other one.

So what's the problem now?

In this case,(and I'm no expert so I admit I'm just guessing) we know the European free trade laws are in place, so I'd imagine it's illegal to refuse to sell you that bike because you live in N.I, as long as they will sell the same bike to someone with a UK adress if ya see what I mean  :)

I know it's convoluted, but the issue, surely, is that the purchaser in NI has a UK address, but NOT a GB address.

I find it unfathomable that any dealer selling high-cost items won't bend over backwards to complete a sale.

And it's hardly time-consuming or expensive for a dealer to register the bike in their name (I assume the buyer will still pay top line for a zero miles bike) which would allow the buyer to take the bike back to Ulster. I'm also assuming that the buyer would pay the paltry costs involved.

It's utter madness.

Write to your MP, why don't you?

Although it's tough if you're 'represented' by one of those IRA terorists who are masquerading as Sinn Fein.
