Had enough!

Well the dealer's withdrawing the offer of a loan bike was described as 'unhelpful'.

BMW Motorrad also have some bikes available but, since it's almost Christmas, I've suggested that we look at this after 4 January if the matter is ongoing.

So yes BMW Motorrad have offered one if I need it - a completely opposite stance to the dealer a few days ago.

It's good to hear that BMW UK have offered you a courtesy bike and that your issue is now hopefully moving towards a positive resolution :thumby:

As a geek, if I had this problem with my bike, I would fit one of these current data loggers that measures the current being draw four times per second so that you can see what is happening over the period the battery goes flat. Obviously it would have to be removed when trying to start the bike as it wouldn't pass the current required by the starter motor. It would show if the electronics were waking up and drawing current at random times.

A new replacement bike is the only option for you. You appear to have a Friday Special or a lemon as it is often called.
I think BMW should read this thread as see how many people have replied and read read the thread.
It is looking bad for BMW and my history with the company is that they will always help if the dealer pushes them. They replaced my ABS unit, 5 years out of warranty, FOC after my dealer intervened.
A strong dealer means a good result for you. Gook Luck

To be honest, I'm now losing faith in the dealer at the moment and have used them since they opened.

It should have been sorted on the first or second attempt not twelve months later.

I just hope that Ben Perry can resolve it.

Pretty annoyed and disappointed that it has dragged on for so long and the weather has been pretty good recently.

Thanks again everyone...

My guess is that when it is at the dealer it doesn't show any fault and starts on the button day after day so in the end they change something that might be faulty (but wasn't) and give it back, you then report the fault again and so they go round the loop again.

Well they didn't even escalate it to BMW Motorrad till this December.

Have to see what they propose but, right now a KTM sounds a great idea.

I'd prefer a refund but suspect a possible replacement will be offered.

To be fair no issues with my previous GSs.

I wonder how many of those visits were logged on the Motorrad database as a claim?

From my experience too many claims on the same machine for the same/similar fault will start alarm bells ringing back at the factory Warranty Dept and may even result in a claim or claims being refused by the manufacturer so it's the dealer that foots the bill :blast

These type of faults are often the most difficult to resolve and the best way round them can be to simply get the customer out of the car/bike he/she has and on to another, newer machine :thumby:

You can ask, when the dealer makes a claim on the warranty they have to submit a puma case, customer services should be able to tell you if this was done and how many times, I would personally ask just to see if the dealer had taken the issue seriously. If no case was ever submitted it would suggest the dealer has let you down.

That's an excellent question and I will ask it.

It's been back at the dealer for a month on 4 January, apart from one trip home and back again in the recovery van.

FFS :blast reject the bike. They are taking the piss and you are lieing down and accepting it. I'm not a troll, I had an electrical fault on my 6 week old XR, after one week and still not solved I threatened to reject the bike. Dealer moved heaven and earth and all was solved plus a big wedge of dosh from BMW UK as compo. Don't be a wooser, stand your ground. See my thread in the XR forum.

I think that, they're bending Davel over and royally shafting him

365 days, wtf are you waiting for?

Told them that I want to reject it last week.

Now waiting for 4th January when Ben Perry is next back at BMW Motorrad.

He will liaise with Chester Motorrad now.

Small claims court, on the balance of probabilities its not fit for purpose expect a full refund. Simple. Don't waste any more time and money.

'SMALL' claims court.

Not "new price of a GSA" claims court.

I believe the maximum sum they deal with is around the 5k mark.....still, your answer is as valid as most on these threads :augie

Small claims is up to 10k. You can appeal to claim more. Personally, I would go small claims regardless for the inconvenience and to offset any potential solicitors fees as you will be into 2 grand before you know it if the dealer dig their heels in.

The rules for small claim in England states that you must make reasonable attempts to resolve the issue and you may also be expected to go to mediation before the court will accept the case. There also must be a written request for compensation and a time allowed for a response. Given this has just started I think all the talk of court action is jumping the gun a bit. Come next week when alleged absent managers are back it might well all get sorted out amicably.

This is far from the first time someone has rejected a bike from BMW and from what I can see they have all ended pretty well.

I think some people are jumping the gun a bit here

Regardless of what the OP thought was happening behind the scenes with his dealer what is now clear is it was only just before the Christmas shutdown that the BMW Motorrad Customer Service Dept became involved

Before anyone starts suing or making threats of litigation I think it is only fair and polite to await the Customer Service response to the situation

Think I'd be riding that lump straight through the doors of the dealership ( if I could get it started that is :blast) ....what a joke for such an expensive bike.
