Received another reply today from the escalation team @ BMW
Basically they do not want to know. They are not faulty. Later grips will not work due to to electrical mapping.
So to all affected users - remember this when you consider buying any BMW product.

Thanks for your latest email to Stacey, which has been passed for my response. I’m sorry to hear about your unhappiness with the heated grips of your BMW R 1200 GS TE – I can understand your disappointment.
We’re aware there are people on forums talking about the heated grips on our bikes. We do occasionally come across BMW customers who have had a similar experience. We’ve looked into this matter for you and do not believe there’s a manufacturing defect. As there’s no repair we can make to your bike, unfortunately we’re unable to provide any further help – the 2015 model grips can’t be retrofitted to earlier models due to their electrical mapping.
If you don’t think we’ve been fair, you might want to contact the Motorcycle Industry Association - our industry regulator. They’re there to make sure we’ve acted reasonably and in line with industry codes. I have provided the contact details below:
