Well I have spoken with Ben Perry again this morning and, I'm delighted to say, that the bike will be replaced with a contribution from me for the mileage on my old bike, which is fair enough.
So thanks to everyone who has contributed on here and to Ben Perry, of BMW Motorrad, who has been really helpful in resolving the matter.
It's just a great shame that it has taken so long to resolve this but I'm happy with the arrangement.

Excellent news, pleased to hear that after all that time. Perhaps consider posting the VIN number on here so when someone pops up with the same nightmare having bought your faulty bike you can tell 'em all about it.
That's a good outcome.
The old bike will be collected by BMW, taken back to HQ and fixed. It'll then go back into the dealer network (not your dealer though).

Anyway I now have an interesting opportunity as I pretty much have a credit to the value of the GS plus extras.
It seems that a PUMA case was opened up in March with BMW and then, despite problems re-occurring, a fresh case was opened on 22nd December - so nine months later. No one had gone back to BMW to report that the March issue was on going.
Anyway I now have an interesting opportunity as I pretty much have a credit to the value of the GS plus extras, so I'm trying to decide between another GS (which will no doubt plummet in value, as the dealers have lots of second hand ones) to the same spec, an S1000 XR or going down in size and value to an F800GS plus stuff.
A nice problem to have.
Take an XR out for a whole day (not an hour or two), and be prepared to fall in love.
